Two People Die When Car Flies Into a Swimming Pool
This wreck, which happened in Chino, also seriously injured a third person and caused considerable property damage.
According to the Chino Police Department, a Chevrolet sedan was southbound on Schaefer near East End. The vehicle apparently hit the median and catapulted into the air. The sedan then tore through a home’s retaining wall and went into a swimming pool. All three people in the vehicle were ejected.
One person died at the scene. Emergency responders rushed two others to local hospitals. Only one of these victims survived.
Passenger Injury Claims
Legally, injured passengers have the same rights as injured drivers. Economically, they also have the same needs as injured drivers. However, there are some additional emotional matters to consider in these situations.
Most passengers know most drivers. In fact, these relationships are often quite close. Quite understandably, some injured passengers hesitate to partner with a Los Angeles personal injury attorney and take legal action.
But these actions usually have little, if any, lasting effect on individuals. At-fault drivers are legally responsible for damages. Insurance companies are financially responsible for damages. The insurance company is also financially responsible for other costs, such as legal fees.
The driver’s insurance company will almost certainly raise the driver’s rates, or even cancel coverage altogether. But these things probably would have happened whether or not a victim filed a legal claim.
Damages in a car crash claim usually include compensation for economic losses, such as medical bills, and noneconomic losses, such as pain and suffering.
Property Damage Claims
Slick and occasionally clever TV ads imply that, if you have a property damage claim, the insurance company quickly takes care of everything. But the reality is often far different. In order to produce these commercials, insurance companies must collect a lot more money than they spend.
Delay is a favorite technique. The longer an insurance company holds onto a claim payment, the more interest it earns on this money.
But the law is clear in these situations. Insurance companies have a duty to quickly acknowledge your claim and assign an adjuster to it. Large disasters, like storms or fires, don’t justify delays. Furthermore, this adjuster must conduct a prompt, thorough, and transparent investigation.
If the adjuster approves the claim, the insurance company must pay the full insured value of the loss. Property depreciation is irrelevant. Moreover, the claim payment must make the policyholder whole. For example, if a fire damages part of a floor, the company must either replace the entire floor or ensure that the repair is seamless. Car crashes often cause extensive injuries and property damage.
